LITIGATED CASES:

  • Successfully defended an employee at a Residential Treatment Center against charges that he used excessive force in restraining a resident.

  • Successfully defended an employee at another Residential Treatment Center against charges of negligence in failing to prevent a physical altercation between residents.

  • Succeeded in overturning an “indicated” report of child neglect against a nurse. Had the report been upheld, the client’s chances for future employment would have been seriously diminished.

  • After a three day Child Custody/Relocation Trial, successfully restrained the mother from relocating to a distant state with the child. Had the Court permitted relocation, the child’s ability to maintain regular, frequent visitation and substantial contact with the Father would have been greatly impaired.

  • After a multi-day Child Custody Trial, obtained physical custody of the child for the father and obtained Court approval for the father and child to relocate to a distant county within New York State.

  • Following a multi-day Child Custody Modification Hearing, as Law Guardian for two children, successfully argued for each child to live with a different parent. The Court held that while a separation of siblings is normally discouraged, the best interests of the subject children here required it (especially in light of the expert testimony regarding the conflicting psychological needs of each child).

  • Following a thirteen day Contested Adoption Trial, as Law Guardian for the subject child, successfully argued to the Court that the biological father had forfeited his rights to object to the child’s adoption by his step-father (the child’s mother had remarried) on the grounds that the biological father had failed to maintain regular, frequent and consistent contact with the child.

  • In a contested divorce action, successfully argued that the Court should award one hundred per cent (100%) of the marital residence (the only marital asset) to the wife, given the husband’s history of failure to adequately support the family.

  • In a contested divorce action, successfully argued that the Court should award one hundred per cent of the marital residence (the only remaining marital asset) to the wife, given the husband’s history of non-support and domestic violence.

  • In a divorce action, obtained sole custody of the children for the mother, given the father’s history of non-support and domestic violence.

NEGOTIATED SETTLEMENTS:

  • Representing a physician-husband, successfully negotiated a waiver by his wife of any interest in his medical license or any enhanced earning capacity resulting from obtaining the license.

  • Representing a mother (who had lost custody of her daughter prior to the commencement of the case) successfully negotiated a joint custodial arrangement.

  • Representing a custodial parent (the mother), succeeded in negotiating a modification to the parties’ Settlement Agreement whereby the mother’s obligation to transfer certain assets as part of the property settlement was rescinded.

  • Representing a non-resident, non-custodial parent (the father, residing on the West Coast) successfully negotiated a visitation arrangement whereby the father will be able to maintain maximum steady and consistent contact with the adolescent child (a New York State resident).
