In stepparent adoption, either the birth parent's rights must be terminated or the consent of the birth parent is necessary. All financial and legal responsibility for the adopted child is transferred from the non-custodial parent, who is then released from parental responsibility. The following issues must be considered:

• Obtaining voluntary consent from the non-custodial birth parent; or
• Ascertaining the feasibility of seeking judicial decision on whether the birth parents' consent is necessary
